1. Who we are

Fluentix (fluentix.ai, the "Service") is a language-practice web app. Students practice speaking and writing and get feedback. The Service is for people aged 14 and older, including high school students, college and university students, adult learners, and teachers.

The Service is operated by Fluentix LLC, a Colorado limited liability company (Colorado ID 20258291820) ("Fluentix", "we", "us").

2. Minimum age

You must be at least 14 years old to use Fluentix. This applies to individual sign-ups and to accounts created by a school.

• At sign-up we ask for your date of birth so we can apply the minimum age. If you are under 14, the account is refused. The student Tutor checks the same 14-year gate before a session starts.
• The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 14. If we learn that an account belongs to anyone under 14, we delete it as described in Section 10.
• Users aged 14 to 17 are minors. Section 10 describes the extra limits we apply.

3. Which parts of this policy apply to you

• A student using Fluentix through a school, college, or university: Your school decides how your information is used. We process it on the school's instructions and under our agreement with the school. Send requests about school records to your school first. We help the school respond.
• A teacher or school administrator: We process your account and class information to provide the Service. If you sign up yourself, this policy also covers your own account.
• An individual learner aged 14 or older: Fluentix is responsible for your information as described here. If you are 14 to 17, see Section 10.
• A website visitor: Sections 4, 7, and 8 apply.

If a school has signed an agreement with us, that agreement controls where it differs from this policy.

4. Information we collect

4.1 Account information

• Name, email address, password (stored as a hash), and role (student, teacher, school administrator, or owner).
• Date of birth, collected at sign-up to apply the minimum age. We store that date.
• Google, Microsoft, Apple, Clever, ClassLink, and school OpenID Connect sign-in are optional. A button stays hidden until that sign-in is turned on. Apple may supply a private relay email and sends the name only on the first login. People can sign in with email and password. A new account is not created for anyone under 14.
• Teachers and administrators may add a school name, a curriculum track, class codes, and license or activation codes. We do not ask students for a phone number.
• Onboarding answers: the language you are learning, your own language, goals, level, and daily practice target.

4.2 Learning and practice data

• Voice recordings of spoken practice (kept for 30 days, then deleted), and the transcripts made from them.
• Text you type, and the replies.
• Feedback and scores, plus teacher comments and grades.
• Assignments, submissions, and progress.
• Camera and microphone for practice. The microphone is used on tutor and practice pages. A scan page may use the camera to photograph a page. The speaking video does not send camera video, a student name, or an accommodation field. If the camera or microphone is blocked, you can type, or you can choose a photo or a PDF for a scan.

We do not create a voiceprint. A voice request sends the text to be spoken. Read-aloud audio is not stored. A recording reference, when one exists, is deleted after 30 days.

4.3 Payment information

If you buy a paid plan, Stripe collects your card details. We receive limited information (name, billing email, plan, last four card digits, and payment status). We do not store full card numbers.

4.4 Support communications

Messages you send to support@fluentix.ai or through the support form, and our replies.

4.5 Age-gate information

If someone enters a date of birth under 14, we do not create an account and we do not store that date. We do not set a browser flag for the refused attempt.

4.6 Technical information

• IP address, browser and device type, pages visited, and timestamps, in server and hosting logs.
• We set a sign-in cookie, a language cookie, and cookies that protect sign-in. We do not set advertising cookies or a third-party analytics script.

5. How we use information

• Provide the Service: practice, feedback, progress, and class assignments: Account, learning, and practice information.
• Let teachers and schools see and manage their students' work: Account, learning, and practice information for school users.
• Apply the minimum age and the limits for minors: Date of birth.
• Sign-in, security, and abuse prevention: Account and technical information.
• Service emails (sign-in codes, account notices, receipts): Email address.
• Process payments: Payment information.
• Answer support requests: Support messages and account information.
• Maintain the Service: Technical information, and de-identified or aggregated learning information.
• Comply with law and enforce our Terms: As needed.

What we never do with student information:

• We do not sell personal information, and we do not share it for cross-context behavioral advertising.
• We do not use student information for targeted advertising or to build advertising profiles.
• We do not use student work to train models, and we do not authorize a provider to use student work to train its models.
• We do not use student information for anything other than providing the Service or the purposes the school authorized.

6. Subprocessors and other recipients

We share personal information with service providers that help us run Fluentix, under contracts that limit their use of it. The current list is the Subprocessor List.

The Service can call a language model, a voice provider, a talking-face provider, Stripe, an email provider, and Google or Microsoft sign-in, and only when that provider is configured.

Other disclosures:

• Your school: for school users, authorized teachers and administrators at your school can see your work and results.
• Legal reasons: when the law requires it, or to protect the safety of users or the public. Where the law allows, we tell the school, or you, first.
• A merger or sale: student information stays subject to this policy and our school agreements, and the buyer must honor them.

We give schools 30 days of notice before adding a subprocessor that will process student information.

7. Cookies and browser storage

We set a sign-in cookie, a language cookie, and cookies that protect sign-in. We do not set advertising cookies. We do not sell or share personal information, so there is no sale or share to opt out of.

8. Retention and deletion

We keep personal information only as long as needed for the purposes above. Periods are in the Data Retention and Deletion Schedule.

• Voice recordings: 30 days, then deleted.
• Transcripts, scores, and feedback: Life of the account, or the shorter period in the school agreement.
• School information after the agreement ends: 60 days after the contract end date, or sooner if the agreement or the school sets an earlier date.
• Individual accounts after a deletion request: 30 days from active systems after approval. Backups are overwritten within 35 days.
• Accounts found to belong to anyone under 14: Suspended at once, then deleted within 7 days.
• Payment records: 7 years, for tax and accounting.

A signed-in student or parent submits a correction or deletion from the records page. The school approves it before anything changes. An account with no school is approved by Fluentix support. A signed-in person can also delete expired voice references from privacy settings.

9. Security

We use administrative, technical, and physical safeguards suited to student information, including transport security, a referrer policy, a permissions policy, frame denial except where a learning-platform frame is required, and an enforcing Content Security Policy. Signed-out people are sent to the login page. No system is perfectly secure. If an incident affects your information, we notify the school or you as the law and our agreements require.

10. Minors and children

The Service is not directed to children under 13. Because our minimum age is 14, we also remove accounts of anyone under 14.

If we find an under-age account, we suspend it at once, delete the personal information within 7 days, and tell the school if it is a school account. Parents and teachers can report an under-age account to support@fluentix.ai.

For users aged 14 to 17, we:

• collect only what the Service needs, and do not ask students for phone numbers;
• never use their information for advertising, sale, or profiling unrelated to learning;
• use these defaults: no public profile, no public ranking, and no direct messages between users;
• tell them they are talking to an AI, not a person;
• let a parent or legal guardian ask to review, correct, or delete the minor's information where the law gives them that right. For school users, parent requests go through the school.

11. Schools

When a school, college, or university uses Fluentix, student education records stay under the school's control. We use them to provide the Service the school asked for. We do not re-disclose them except as the school authorizes or the law allows.

Parents and eligible students can review records and ask for corrections through the school. We help the school respond within 10 business days of its request.

A school may ask us to sign a data-processing agreement. Email support@fluentix.ai to ask for one.

12. Requests about your information

You may ask to know, access, correct, or delete personal information, and to opt out of sale, sharing, and targeted advertising. We do not sell or share personal information and we do not do targeted advertising. Email support@fluentix.ai. We verify the request and respond within 30 days. You may use an authorized agent where the law permits. We will not discriminate against you for using these requests.

13. People outside the United States

For school users, the school decides why the information is processed and Fluentix processes it under the school agreement. For individual learners and visitors, Fluentix LLC is responsible as described in this policy.

Our minimum age is 14 everywhere. Where the law requires a parent's permission before we rely on consent, we do not rely on consent without it.

If personal information is processed in the United States, the contract with the school or the individual states the terms that apply.

You may ask for access, correction, deletion, restriction, portability, or an objection, and you may withdraw consent. School users should contact their school first. You may also complain to a data-protection authority where the law gives you that right.

14. Changes

We post changes here and update the Last updated date. For a material change affecting student information, we notify schools at least 30 days in advance and do not apply the change to existing student information without the school's agreement.
